Medicaid

Known as the Peach State Health Plan, Medicaid is a state-run health care plan that can help offset some of the costs for necessary in-home medical needs or other medical needs in general. Understand Georgia laws and regulations for independent living communities

In Marietta, there are three stand-alone A Place For Mom partnered independent living communities. Because these are not considered senior care facilities, they are not required to meet the same standards as senior care facilities. However, as you will see later in this section, 14 of the A Place For Mom partnered independent living communities are a combination of independent living and some form of assisted living or memory care. These communities are held to higher standards and are regulated and inspected regularly.

The stand-alone independent living communities do not require licensing, but they still have to follow city, state, and federal guidelines. The Georgia Fair Housing Act guarantees that every resident in Georgia has an equal opportunity to pursue housing that aligns with their financial capabilities. It strictly forbids any form of housing discrimination based on disability, sex, race, national origin, religion, or familial status.

All stand-alone independent living communities must follow the guidelines laid out by the Americans with Disabilities Act (ADA). The ADA makes sure that landlords cannot discriminate or deny housing to any one person solely because of disability. Any resident complaint regarding the ADA can go through the City of Marietta Risk Manager/ADA Coordinator, Department of Human Resources, and Risk Management.

All stand-alone independent living communities are required to be in good repair and deemed safe for residents, as per the Georgia Landlord-Tenant Handbook. Heating, plumbing, and electricity must always be in order and buildings must receive ordinary care. All stand-alone independent living communities are required to be equipped with smoke alarms, as per the residential housing code.

Combination care facilities

Independent living communities that are a combination of assisted living or memory care are required to be licensed by the state of Georgia. These buildings are required to receive a Health Care Facility Regulation license (HFR) through the Georgia Department of Community Health. Licensing is acquired after each successful inspection. Anyone interested in seeing the results of inspections for specific facilities or communities can find them online.

For every assisted living or memory care facility, there must be at least one awake staff member on the premises for every 15 residents.[04] The on-site manager must be at least 21 years of age. No one under the age of 18 is permitted to work in an assisted living or memory care facility. All staff members are to receive training within their first 60 days of working at an assisted living or memory care facility. This training includes first aid, cardiopulmonary resuscitation, medical and social needs, residents’ rights, and other duties.

All assisted living facilities must come up with a care plan for residents within 14 days of residents moving into the facility.[04] This care plan must include residents’ social needs and services needed. The staff primarily responsible for overseeing this care plan will be identified at this time. Care plans also include any doctor’s orders plus plans to deal with specific behaviors. Assisted living facilities are also required to provide activities that promote physical, mental, and social well-being.

Memory care facilities must follow these same guidelines while also ensuring the safety of those with cognitive deficiencies. This means there must be measures in place to prevent wandering or getting lost.[04]
